Tell Kroger: Stop the Illegal Time & Attendance Policy, Respect Our Union Contract!

Kroger's new Walmart-style, points-based, AI-powered time and attendance policy being rolled out in Colorado, Georgia, Indiana, Ohio, Tennessee, Texas, and possibly more states is a violation of our union contract and of the National Labor Relations Act. Sign the petition now to demand Kroger respect our union contract!

This policy punishes workers with disabilities, family and childcare responsibilities, limited access to transportation, and more. It puts the blame of understaffing on workers, and not on the corporate decisions to slash our labor hours and keep our stores running on skeleton crews.

Kroger is illegally attempting mid-contract changes without bargaining with our union first. Some UFCW locals have already filed grievances against Kroger for refusing to bargain over the policy.

In some union contracts, this policy is also a violation of clauses on AI and other automated technology, as well as existing time and attendance policies and progressive discipline.

Unilateral changes in terms and conditions of employment without bargaining in good faith with our union is a violation of the National Labor Relations Act and an unfair labor practice.

Tell Kroger to stop the illegal, AI-powered policy. Stop trying to make Kroger look like non-union Walmart.

What’s our union doing about the policy?

In some areas, UFCW locals have filed class-action grievances and unfair labor practice (ULP) charges against Kroger for refusing to bargain in good faith with the union over the policy. This is a crucial step to fighting the policy.

But others have chosen not to file grievances or ULP charges, and have instead accepted the policy roll-out, repeating the company line on “management rights.” Meanwhile, the UFCW International has been silent on this pressing issue impacting tens of thousands of Kroger workers nationwide.

Sign the petition to call on UFCW leadership at the local and International Union level to take decisive action against this policy.
